Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of FrontMart, a hosted online store and e-commerce software platform operated by APKHOST PRIVATE LIMITED (Private Limited Company). By creating an account, activating a Store, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.
In these Terms, "we", "us", and "our" mean APKHOST PRIVATE LIMITED. "You", "your", and "Merchant" mean the person or business that creates, owns, administers, or operates an account or Store through FrontMart.
1. What We Provide
FrontMart is a cloud-based software platform that enables Merchants to create, configure, host, customize, and operate online storefronts.
The Service may include, depending on the applicable plan:
- online storefront creation and hosting
- product and catalogue management
- banner and content management
- custom domain support
- store branding and customization
- shopping cart and order-management functionality
- shipping and delivery configuration
- product-level shipping and delivery settings
- tax and billing configuration
- QR-code functionality
- product sharing functionality
- image processing, optimization, and CDN delivery
- store timing and delivery scheduling
- administrative dashboard
- authentication and account-management functionality
- backup and infrastructure services
- other features introduced or modified from time to time
Features, limits, storage, product capacity, usage allowances, and other resources depend on the Merchant's selected plan or applicable commercial agreement.
2. Your Store and Your Business
FrontMart provides software and infrastructure that enables a Merchant to operate an online Store. The Merchant independently operates its own business and is solely responsible for:
- the products and services it offers
- product prices
- product descriptions and claims
- product availability
- inventory
- taxes and applicable registrations
- licences and permissions
- shipping and delivery commitments
- returns and refunds
- warranties
- customer communications
- customer service
- advertising and marketing
- compliance with applicable laws and regulations
- all commercial transactions conducted through the Merchant's Store
The Merchant acknowledges that FrontMart does not control the Merchant's underlying business operations, products, pricing, fulfilment, customer relationships, or commercial decisions.
3. FrontMart Is Not the Seller
Unless expressly agreed otherwise in writing, FrontMart is not:
- the manufacturer of the Merchant's products
- the owner of the Merchant's inventory
- the seller or reseller of the Merchant's products
- the importer or exporter of the Merchant's products
- the Merchant's agent for commercial transactions
- the Merchant's delivery provider
- the Merchant's customer-support provider
- a party to the contract of sale between the Merchant and its customer merely because the transaction is facilitated through the software
The contract for the sale or supply of goods or services is between the Merchant and the applicable customer.
The Merchant must not represent or imply that FrontMart has manufactured, supplied, endorsed, guaranteed, or sold any product or service offered through the Merchant's Store.
4. Merchant Responsibility for Products and Services
The Merchant is solely responsible for ensuring that every product or service listed through its Store is lawful and may legally be advertised, offered, and sold.
The Merchant shall comply with all applicable:
- central and state laws
- rules and regulations
- consumer-protection requirements
- tax requirements
- licensing requirements
- product-specific regulations
- advertising requirements
- intellectual-property laws
- data-protection and privacy obligations
- other regulatory requirements applicable to its business
The Merchant shall obtain and maintain all licences, registrations, approvals, certificates, and permissions required for its business.
5. Prohibited Products and Activities
The Merchant shall not use FrontMart to advertise, offer, sell, distribute, facilitate, or promote any product, service, content, or activity that is unlawful, prohibited, fraudulent, deceptive, or otherwise restricted under applicable law.
This includes, without limitation:
- goods or services whose sale, possession, distribution, or advertisement is prohibited by law
- counterfeit or pirated goods
- stolen or unlawfully obtained goods
- products infringing third-party intellectual-property rights
- products requiring a licence or regulatory approval where the Merchant does not possess the required authorization
- fraudulent or deceptive products or claims
- unlawful financial or investment schemes
- products or services prohibited by a competent governmental or regulatory authority
- content or activities that violate applicable law
- any category specifically prohibited by FrontMart
- any activity that creates material security, fraud, regulatory, or legal risk to FrontMart or its infrastructure providers
This list is illustrative and does not limit FrontMart's right to restrict additional categories where required by applicable law, regulation, governmental direction, payment-provider requirements, hosting-provider requirements, or legitimate platform-safety considerations.
6. Merchant Content
The Merchant may upload or provide content including product images, descriptions, logos, banners, videos, links, business information, policies, pricing information, tax information, and other materials ("Merchant Content").
The Merchant remains responsible for the legality, accuracy, and ownership of Merchant Content and represents that it has all necessary rights, licences, and permissions required to use it.
The Merchant shall not upload content that infringes the copyright, trademark, privacy, publicity, or other rights of another person or entity.
7. Licence to Operate Merchant Content
The Merchant retains ownership of its intellectual property and Merchant Content, subject to applicable law.
The Merchant grants FrontMart a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, resize, transform, optimize, transmit, display, and otherwise use Merchant Content solely as reasonably necessary to:
- provide the Service
- host the Merchant's Store
- process and optimize images
- deliver content through CDN infrastructure
- maintain backups
- provide technical support
- secure the Platform
- maintain and operate the Service
- perform other activities reasonably necessary to provide the Service
This licence does not transfer ownership of the Merchant's intellectual property to FrontMart.
8. White-Label Stores
Where supported by the applicable plan, a Merchant may operate its Store using its own business name, logo, branding, custom domain, and Store content.
FrontMart may provide the Service on a white-label basis. The absence of visible FrontMart branding on a Merchant's Store does not change the legal relationship between the Merchant and FrontMart.
The Merchant remains responsible for identifying itself appropriately to its customers and for providing disclosures required by applicable law.
9. Custom Domains
Where supported, the Merchant may connect a domain owned or controlled by the Merchant to its Store.
The Merchant is responsible for:
- ownership of the domain
- domain registration
- domain renewal
- DNS configuration
- trademark rights
- lawful use of the domain
- any fees charged by the domain registrar
FrontMart provides technical functionality for connecting the domain to the Merchant's Store but does not acquire ownership of the Merchant's domain.
The Merchant shall not connect a domain that infringes the rights of another person or entity or is otherwise unlawful.
10. Merchant Policies
FrontMart may provide default templates or tools for policies such as Privacy Policy, Terms and Conditions, Shipping Policy, Return/Refund Policy, and other Store policies.
These templates are provided as configurable software content and are not a representation or guarantee that they satisfy every legal requirement applicable to a particular Merchant.
The Merchant may edit or replace such policies where supported by the Service. The Merchant is solely responsible for ensuring that its Store policies accurately reflect its business practices and applicable legal requirements.
The Merchant should obtain professional legal or tax advice where appropriate.
11. Merchant-Customer Transactions
The Merchant is solely responsible for transactions with its customers, including:
- product quality
- product authenticity
- pricing
- availability
- delivery
- shipping
- returns
- refunds
- cancellations
- replacements
- warranty
- customer support
- advertising claims
- other commercial obligations
FrontMart may provide technical functionality for these processes but does not assume the Merchant's underlying commercial obligations merely by providing the software.
12. Payment Gateways and Third-Party Services
The Merchant may connect supported third-party services, including payment gateways, communication providers, or other integrations.
Unless expressly stated otherwise, FrontMart does not control the independent terms, fees, policies, availability, security practices, or operation of such third-party services.
Any transaction charges imposed by a payment gateway or other third-party provider shall be governed by the applicable provider's terms.
FrontMart does not charge a transaction commission merely because a Merchant processes a sale through its Store, unless expressly specified in the applicable commercial plan or agreement.
13. Taxes
The Merchant is responsible for determining and complying with all tax obligations applicable to its business.
Where FrontMart provides tax or billing configuration functionality, such functionality is a software feature and does not constitute tax, accounting, or legal advice.
The Merchant remains responsible for the correctness of:
- tax configuration
- GST status
- tax rates
- invoices
- business information
- customer information
- other tax-related information entered into the Platform
14. Shipping and Delivery
FrontMart provides configurable shipping and delivery functionality.
The Merchant is responsible for configuring shipping charges, delivery areas, delivery times, and related rules accurately according to its actual business capabilities.
FrontMart does not itself undertake to deliver products unless expressly agreed under a separate service.
The Merchant remains responsible for fulfilling delivery commitments made to its customers.
15. Account Security
The Merchant is responsible for maintaining the confidentiality and security of its account and authorized access mechanisms.
The Merchant shall not:
- share unauthorized access credentials
- permit unauthorized persons to access its administrative account
- attempt to bypass security mechanisms
- access another Merchant's account
- attempt to access another Merchant's data
- use the Service to compromise the security of the Platform
The Merchant shall promptly notify FrontMart if it reasonably suspects unauthorized access or compromise.
16. Multi-Tenant Data Separation
FrontMart is designed as a multi-tenant platform. Merchant data and configuration are intended to be logically separated between individual Stores.
A Merchant shall not attempt to access, retrieve, modify, or interfere with another Merchant's data, Store, account, or resources.
Unauthorized access or attempted access to another Merchant's information constitutes a material violation of these Terms.
17. Suspension and Restriction
FrontMart may, subject to applicable law, suspend, restrict, disable, or terminate a Merchant's Store, account, listing, content, domain configuration, or access to part of the Service where:
- the Merchant violates these Terms
- FrontMart reasonably believes unlawful activity is occurring
- FrontMart receives a valid legal, governmental, regulatory, or law-enforcement direction
- the Store presents a material security or fraud risk
- continued operation creates a material legal or regulatory risk
- a third-party infrastructure provider requires such action
- the Merchant fails to pay applicable fees
- continued provision of the Service is otherwise prohibited or materially restricted
Where reasonably practicable, FrontMart may provide notice and an opportunity to remedy the violation.
However, FrontMart may take immediate action where necessary to comply with law, protect users, prevent fraud or abuse, protect infrastructure, or respond to urgent risks.
18. Removal or Restriction of Unlawful Content
If FrontMart receives a valid legal notice, governmental direction, regulatory direction, or other legally sufficient request concerning potentially unlawful content or activity, FrontMart may take actions required or reasonably appropriate under applicable law.
Depending on the circumstances, such action may include:
- restricting access to a listing
- disabling content
- suspending a Store
- suspending an account
- disabling a domain
- preserving relevant records where legally required
- terminating the Service
Nothing in these Terms prevents FrontMart from complying with applicable law or valid legal directions.
19. Indemnification
To the extent permitted by applicable law, the Merchant agrees to indemnify and hold harmless APKHOST PRIVATE LIMITED, FrontMart, and their respective directors, officers, employees, contractors, and service providers against claims, losses, liabilities, penalties, damages, costs, and reasonable legal expenses arising out of or relating to:
- products or services offered or sold by the Merchant
- illegal, prohibited, or restricted products or activities conducted through the Store
- the Merchant's violation of applicable law
- inaccurate or misleading information supplied by the Merchant
- intellectual-property infringement by Merchant Content or products
- the Merchant's breach of these Terms
- disputes between the Merchant and its customers
- the Merchant's commercial operations
This provision applies only to the extent permitted by applicable law and does not exclude liability that cannot legally be excluded or transferred.
20. Limitation of FrontMart's Role
FrontMart provides software and infrastructure functionality. Except where expressly agreed otherwise, FrontMart does not guarantee:
- the Merchant's sales
- the Merchant's revenue
- customer acquisition
- customer retention
- product demand
- delivery performance by the Merchant
- product quality
- product legality
- Merchant profitability
- any particular commercial outcome
The Merchant independently decides how to operate and promote its business.
21. Service Availability
FrontMart will use commercially reasonable efforts to maintain the availability and functionality of the Service.
Temporary interruption may occur due to:
- maintenance
- software updates
- infrastructure failures
- third-party service failures
- network failures
- security incidents
- force majeure events
- governmental actions
- other circumstances beyond FrontMart's reasonable control
Where commercially reasonable, FrontMart may perform maintenance and infrastructure changes to improve reliability, performance, or security.
22. Backups and Recovery
FrontMart may maintain backups and recovery mechanisms for Platform data according to its internal infrastructure and backup practices.
Backups are intended to support operational recovery and do not constitute an independent archival service for the Merchant.
The Merchant remains responsible for maintaining copies of any information that it independently requires for its business.
23. Intellectual Property of FrontMart
The FrontMart software, Platform, source code, architecture, interface, trademarks, logos, documentation, designs, and other proprietary materials belonging to FrontMart or its licensors remain the property of their respective owners.
Except as expressly permitted under these Terms, the Merchant shall not:
- copy the software
- reverse engineer the Platform
- decompile or disassemble the software
- attempt to obtain source code
- resell the underlying software without authorization
- circumvent technical limitations
- use FrontMart intellectual property outside the scope of the Service
24. Prohibited Technical Activities
The Merchant shall not:
- attempt unauthorized access to the Platform
- conduct vulnerability exploitation without written authorization
- introduce malicious code
- conduct denial-of-service attacks
- abuse APIs
- circumvent rate limits
- scrape protected Platform data
- attempt to access another tenant
- interfere with Platform infrastructure
- use the Service to facilitate cyber abuse
25. Subscription and Plans
FrontMart may provide multiple subscription plans with different resource limits and features.
Plan limits may include, without limitation:
- number of products
- number of banners
- storage or other resources
- features
- usage limits
- custom requirements
The applicable plan and pricing shall be displayed at the time of subscription or otherwise agreed between FrontMart and the Merchant.
FrontMart may introduce new plans or modify future plan offerings subject to applicable contractual and legal requirements.
26. Custom Plans
FrontMart may provide customized plans based on a Merchant's requirements.
Custom plans may include customized:
- product limits
- banner limits
- resource allocation
- features
- support
- infrastructure requirements
- commercial terms
Custom arrangements may be governed by a separate written agreement. If a separate written agreement expressly conflicts with these Terms, the separate agreement will control to the extent of that conflict.
27. Termination by Merchant
The Merchant may terminate its subscription according to the cancellation procedure provided by FrontMart.
Unless otherwise required by applicable law or expressly agreed under a specific commercial arrangement, cancellation does not automatically terminate the already-paid subscription period.
The Merchant remains responsible for outstanding fees or liabilities incurred before termination.
28. Termination by FrontMart
FrontMart may terminate or suspend the Merchant's access where permitted under these Terms and applicable law, particularly in cases involving:
- material breach
- illegal activity
- prohibited products or activities
- fraud
- security abuse
- non-payment
- repeated violations
- legal or regulatory requirements
- material risk to FrontMart, other Merchants, or infrastructure
29. Effect of Termination
Upon termination:
- access to the Merchant's Store may be disabled
- custom domain connectivity may cease
- Platform functionality may become unavailable
- outstanding amounts may remain payable
- data may be handled according to FrontMart's applicable retention and deletion practices and applicable law
Where applicable and technically feasible, FrontMart may provide a reasonable mechanism for data export, subject to the Merchant's plan, technical limitations, payment status, legal requirements, security considerations, and other applicable conditions.
30. Changes to the Service
FrontMart may modify, improve, replace, or discontinue features of the Service from time to time.
Changes may be made for reasons including:
- security
- performance
- legal compliance
- infrastructure changes
- product development
- third-party dependency changes
- general improvement of the Service
Where required by applicable law or contractual commitments, FrontMart will provide appropriate notice.
31. Privacy
Personal information processed through FrontMart shall be handled in accordance with the applicable Privacy Policy and applicable law.
Where a Merchant independently collects personal information from its customers through its Store, the Merchant remains responsible for its own legal obligations concerning such information and customer-facing privacy disclosures, subject to the actual technical and legal role of FrontMart in processing that information.
32. Third-Party Infrastructure
FrontMart may rely on third-party infrastructure and service providers for hosting, databases, CDN, communications, authentication, payments, monitoring, storage, and other technical services.
The Merchant acknowledges that availability of certain features may depend on such third-party services.
FrontMart will take commercially reasonable measures to manage its third-party dependencies but cannot guarantee uninterrupted availability of independently operated third-party services.
33. No Legal, Tax, or Business Advice
Information, templates, configurations, and tools provided through FrontMart are intended to facilitate software functionality.
They do not constitute:
- legal advice
- tax advice
- accounting advice
- regulatory advice
- financial advice
- a guarantee of business compliance
The Merchant should obtain professional advice where appropriate.
34. Compliance with Law
Each party shall comply with laws applicable to its own activities and obligations under the Service.
Nothing in these Terms is intended to exclude or restrict any obligation that cannot legally be excluded or restricted.
Where mandatory law provides rights or protections that cannot be waived by contract, those rights shall continue to apply.
35. Governing Law
These Terms shall be governed by the laws of India, subject to applicable mandatory legal provisions.
Subject to applicable mandatory jurisdictional requirements, the courts having appropriate jurisdiction at Anuppur, Madhya Pradesh shall have jurisdiction over disputes arising from or relating to the Service.
36. Dispute Resolution
The parties shall endeavour to resolve disputes relating to the Service through good-faith communication.
Where required or agreed, disputes may be referred to mediation, arbitration, or other dispute-resolution mechanisms in accordance with a separate agreement or applicable law.
Nothing in this section prevents a party from seeking urgent statutory or judicial relief where legally available.
37. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be modified or interpreted to the minimum extent necessary to make it enforceable where legally possible.
The remaining provisions shall continue in effect to the extent permitted by law.
38. Entire Agreement
These Terms, together with the applicable Privacy Policy, Refund & Cancellation Policy, applicable pricing terms, and other policies expressly incorporated by reference, constitute the agreement governing the Merchant's use of FrontMart, except where a separate written agreement expressly supersedes or modifies these Terms.
39. Merchant Acknowledgement
By creating or activating a FrontMart Store, the Merchant acknowledges that:
- the Merchant operates an independent business
- the Merchant is responsible for its products and services
- the Merchant is responsible for compliance with applicable laws
- the Merchant is responsible for its customers and commercial transactions
- FrontMart provides technology and infrastructure
- the Merchant must not use FrontMart for unlawful or prohibited activities
- FrontMart may restrict or suspend unlawful or abusive use where permitted or required by law or these Terms
- the Merchant has had an opportunity to review these Terms and applicable policies
